Surrogacy in Ukraine
Conditions required for surrogacy are as follows:
-
availability of medical indications for surrogacy;
-
documents required for surrogacy;
-
the spouses (or one of the future parents) in whose interest the surrogacy is carried out must have genetic relation with the child;
-
a surrogate mother should not have direct genetic relation with the child.
There are the following indications for surrogacy:
-
the absence of the uterus (congenital or acquired);
-
deformation of the cavity or cervix at congenital malformations or due to surgery, benign tumours, which make pregnancy impossible;
-
structural-morphological or anatomical changes of the endometrium, leading to loss of receptivity, synechiae of the uterine cavity, which do not respond to treatment;
-
severe somatic diseases, in which pregnancy threatens the further health or life of the recipient, but which do not affect the health of the future child;
-
unsuccessful repeated ART attempts (4 or more times) with repeated receiving of high-quality embryos, the transfer of which did not lead to pregnancy.
Only a full-aged legally capable woman can be a surrogate mother, provided she has her own healthy child, a voluntary written application, and in the absence of medical contraindications.

Contraindications for surrogacy (according to the legislation of Ukraine) are as follows:
-
somatic and mental diseases that are contraindications for pregnancy and childbirth;
-
the length of the uterine body is less than 35 mm;
-
acute inflammatory diseases of any localization;
-
congenital malformations or acquired deformities of the uterine cavity, which do not allow implantation of the embryo (s) and carrying of a pregnancy;
-
benign tumours of the uterus that deform the uterine cavity and (or) require surgical treatment;
-
malignant neoplasms of any localization.
List of documents from the surrogate mother required for surrogacy includes:
-
application of the patient / patients on the use of ART;
-
a copy of the surrogate mother's passport;
-
a copy of the marriage certificate or divorce certificate of the surrogate mother (except for single women);
-
a copy of the child / children birth certificate;
-
consent of the surrogate mother's husband to her participation in the surrogacy program (except for single women).
List of documents from the spouses in whose interest surrogacy is carried out includes:
-
application of the patient / patients on the use of ART;
-
copies of passports;
-
a copy of the marriage certificate;
-
notarized copy of the written mutual agreement between a surrogate mother and a woman (husband) or spouses.
Algorithm of carrying out surrogacy:
-
examination of the biological parents or one of them under the condition of a program with oocytes or sperm donation;
-
receiving of at least one embryo suitable for transfer to the uterine cavity of a surrogate mother;
-
selection and examination of a surrogate mother;
-
legal and notary formalization of the program;
-
preparation of the endometrium for embryos cryopreservation;
-
the procedure of transferring the embryo to the uterus of a surrogate mother;
-
pregnancy diagnostics;
-
prenatal care at the women's health clinic;
-
baby delivery;
-
registration of documents for the child.
If a baby has been delivered by a woman who has been transferred a human embryo conceived by the spouses as a result of the ART use, the state registration of the childbirth is carried out upon the request of the spouses who agreed to such transfer.
In this case, along with the document confirming the birth of the child by this woman, an application about her consent to the registration of the spouses as the child's parents with a notarized signature on it, as well as a certificate of genetic relationship between parents (mother or father) and the child must be submitted.
